Binding Arbitration Agreement

1. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms, the App, or your use of the App, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration.
This includes, but is not limited to:
- Disputes regarding trading losses
- Disputes regarding app functionality
- Disputes regarding data privacy
- Any claims for damages of any kind
2. No Class Actions
CLASS ACTION WAIVER: You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law:
- You waive the right to participate in class action lawsuits.
- You waive the right to participate in class-wide arbitration.
- You waive the right to act as a private attorney general.
- All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
3. Arbitrator
Arbitration will be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes.
The arbitration shall be conducted by a single arbitrator, and the arbitrator's decision shall be final and binding.
4. Arbitration Procedures
- Location: Arbitration shall take place in the United States, or at another mutually agreed location.
- Language: The arbitration shall be conducted in English.
- Costs: Each party shall bear its own costs and attorney's fees. AAA filing fees shall be split equally unless otherwise determined by the arbitrator.
- Confidentiality: All arbitration proceedings and outcomes shall remain confidential.
5. Governing Law
This Arbitration Agreement and all disputes arising hereunder are governed by the Federal Arbitration Act and the laws of the State of California, without regard to conflict of law principles.
6. Severability
If any provision of this Arbitration Agreement is found to be unenforceable, that provision shall be severed and the remainder of the agreement shall continue in full force and effect.
7. Opt-Out
You may opt out of this Arbitration Agreement by sending written notice to waggleman09@gmail.com within 30 days of first using the App. Your notice must include your name and a statement that you wish to opt out of the Arbitration Agreement.
